Welcome to Grade My Investments, operated by Leopard Data Corporation ("Grade My Investments," "we," "us," or "our"). By accessing or using the Grade My Investments investment analytics platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. Please read them carefully before using the Service.

1. Program Description

Grade My Investments is an advanced investment analytics platform that generates detailed stock analysis reports. The Service allows users to create symbol lists, generate investment reports using AI-powered analytics, view AI-powered dashboards, and receive report notifications via email and SMS. Grade My Investments is designed for informational and educational purposes to assist with investment research.

2. Account Registration and Responsibility

To use Grade My Investments, you must:

  • Sign in using a valid Google account
  • Provide accurate and complete account information
  • Be at least 18 years of age
  • Register a valid payment method (unless designated as a free account by an administrator)

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You are solely responsible for all activity that occurs under your account, whether or not authorized by you. You must immediately notify us at inquiries@leoparddata.com of any unauthorized use of your account or any other security breach. You will be liable for any use made of your account and for any losses incurred by Grade My Investments or others due to such use.

3. Service Fees, Billing, and Refunds

Grade My Investments charges fees for report generation based on usage. Fees are calculated per report based on the number of symbols analyzed. All payments are processed securely through Stripe. You agree to pay all fees associated with your use of the Service.

Pricing details are available on the Pricing page and may be updated from time to time with notice.

3a. Refund and Cancellation Policy

Fees for reports generated through the Service are nonrefundable once a report has been successfully delivered. If a report fails to generate due to a system error, you will not be charged, or a credit will be issued to your account. You may close your account at any time; however, no refund will be issued for previously generated reports or storage charges already incurred. Grade My Investments reserves the right to offer refunds or credits at its sole discretion. There are no long-term contracts or monthly minimums — you only pay for what you use.

4. SMS Messaging Terms

By providing your phone number and opting in to SMS notifications, you agree to the following:

  • Program Name: Grade My Investments Report Notifications
  • Description: You will receive SMS notifications when your investment analysis reports are ready for download, and occasional account-related alerts.
  • Message Frequency: Message frequency varies based on your report generation activity. You may receive up to 10 messages per day depending on your usage.
  • Message and Data Rates: Message and data rates may apply. Check with your wireless carrier for details about your messaging plan.
SMS Opt-Out and Support
  • To opt out of SMS messages at any time, reply STOP to any message you receive from Grade My Investments.
  • For help or support, reply HELP to any message, or contact us at inquiries@leoparddata.com.

You may also manage your SMS notification preferences from your account settings within the Grade My Investments platform. Opting out of SMS notifications will not affect your ability to use the Service or receive reports via email.

5. Investment Disclaimer

Grade My Investments does not provide financial advice. All reports, analytics, grades, scores, sentiment labels, and data provided through the Service are for informational and educational purposes only. They should not be construed as investment advice, recommendations, or solicitations to buy or sell any securities.

You acknowledge and agree that:

  • All investment decisions are made solely at your own risk
  • Past performance does not guarantee future results
  • Stock market data may be delayed, incomplete, or contain inaccuracies
  • Grade My Investments is not registered with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state or international securities regulatory authority as an investment advisor, broker-dealer, or financial planner
  • You should consult a qualified, licensed financial professional before making any investment decisions
  • No fiduciary relationship is created between you and Grade My Investments by your use of the Service

5a. AI-Generated Content

Grade My Investments uses artificial intelligence, including third-party AI models (such as Anthropic's Claude), to generate analysis, grades, sentiment scores, health scores, recommendations labels (e.g., "Strong Buy," "Buy," "Hold," "Sell"), forecasts, and other outputs. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or omissions
  • AI models may produce different results for the same data at different times
  • Labels such as "Strong Buy," "Buy," "Hold," or "Sell" are AI-generated classifications based on data analysis and are not personalized investment recommendations
  • AI-generated forecasts and projections are speculative and should not be relied upon as predictions of future performance
  • Grade My Investments does not guarantee the accuracy, completeness, or reliability of any AI-generated content
  • You assume full responsibility for any actions taken based on AI-generated content

5b. Data Sources, Third-Party Content, and Timeliness

Financial data displayed in the Service is sourced from third-party providers, including Financial Modeling Prep (FMP) and other data aggregators. The Service may contain links to third-party websites, data, or content that is not owned or controlled by Grade My Investments. You acknowledge and agree that:

  • Data may be delayed by minutes, hours, or days depending on the source and data type
  • Grade My Investments does not independently verify the accuracy of third-party data
  • Real-time or current pricing data is not guaranteed
  • Historical data may be revised or corrected by data providers after it has been displayed in the Service
  • Data availability and coverage may vary by symbol, market, or geographic region
  • Third-party data providers provide data on an "as is" basis, and neither Grade My Investments nor its data providers warrant the accuracy, completeness, or timeliness of such data
  • Grade My Investments shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with reliance on any third-party content, data, or services

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Resell, redistribute, or commercially exploit reports without authorization
  • Use automated tools to scrape, crawl, or extract data from the platform
  • Systematically download or store Service content in bulk
  • Use any content, data, reports, or outputs from the Service for training machine learning or artificial intelligence models
  • Use the Service in any manner that could damage, disable, overburden, or impair our servers or infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

7. Intellectual Property

All content, features, and functionality of the Grade My Investments platform — including reports, analytics, software, design, text, graphics, logos, and trademarks — are owned by Grade My Investments (Leopard Data Corporation) and are protected by United States and international intellectual property laws. Reports generated for your account are licensed to you for personal, non-commercial use only.

7a. Copyright Complaints (DMCA)

If you believe that content available through the Service infringes your copyright or other intellectual property rights, please notify us at inquiries@leoparddata.com with the following information:

  • A description of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing and its location on the Service
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

We will respond to valid notices in accordance with the Digital Millennium Copyright Act (DMCA).

8. Service Availability and Modifications

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted access and may perform maintenance or experience downtime. Grade My Investments reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, discontinuation, or any loss or damage resulting from service interruptions.

9. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us at inquiries@leoparddata.com. Upon termination, your right to use the Service ceases immediately. Sections 5, 10, 11, 12, 13, 14, and 15 of these Terms shall survive any termination of your account.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GRADE MY INVESTMENTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GRADE MY INVESTMENTS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE CONTENT, DATA, ANALYTICS, REPORTS, OR AI-GENERATED OUTPUTS WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GRADE MY INVESTMENTS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADE MY INVESTMENTS, LEOPARD DATA LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INVESTMENT LOSSES, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GRADE MY INVESTMENTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF GRADE MY INVESTMENTS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE TOTAL AMOUNTS PAID BY YOU TO GRADE MY INVESTMENTS DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Grade My Investments, Leopard Data Corporation, and their respective officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Any investment decisions you make based on information obtained through the Service
  • Any content you submit through the Service
  • Your violation of any applicable law, rule, or regulation

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

14a. Informal Resolution

Before initiating any arbitration or court proceeding, you agree to first contact us at inquiries@leoparddata.com and attempt to resolve the dispute informally for at least thirty (30) days.

14b. Binding Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Texas. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

14c. Jury Trial Waiver

EACH PARTY EXPRESSLY WAIVES THE RIGHT TO A TRIAL BY JURY IN ANY COURT IN ANY JURISDICTION.

14d. Class Action Waiver

YOU AND GRADE MY INVESTMENTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND GRADE MY INVESTMENTS AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15. Force Majeure

Grade My Investments shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, epidemics, natural disasters, power outages, internet or telecommunications failures, government actions or restrictions, failures of third-party data providers or service providers, cyberattacks, or any other event beyond our reasonable control.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the platform or sending an email to your registered address. The "Effective Date" at the top of these Terms will be updated to reflect the date of the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

17. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Grade My Investments regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.

19. Waiver

The failure of Grade My Investments to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Grade My Investments.
